I received a strange text out of nowhere saying "Hi All,
Just wanted to give you all an update on the Face to Face Training status as there has been many crazy rumours circulating, non of which are true! The truth is about 5 months ago the State Government disregarded our rights by making an example of our company, not only did they cease us from trading they also withheld our payments to the value of 4.8 million. Be mindful this money doesn't represent company profit but was necessary to pay the hundreds of people forced out of work on the lead up to Christmas, a knee jerk reaction from a 60 minute hatchet job with no real regard to the actual truth. Following this was a 4 week audit which consisted of 8 auditors examining approximately 6.000 student files and yet we are still to receive an audit report or findings. In December we lodged Supreme Court action against The Department as we felt the procedural fairness has not been met. The lead up to Christmas we pleaded with The Department for a partial release of funds and for this to be paid directly to all parties effected. This plea was not entertained by The Department at all.
Face to Face has not received a cent since this whole ordeal begun (approximately 6 months) but has needed to continue to employ many admin staff over this period in order to meet The Department and ASQA requirements, failing in these requirements may have lead to no payment at all. As ridiculous as it is, the defence to the Supreme Court proceedings from The Department is a counter claim against F2F, ETA & BCT for a sum of approx 6 million in over payments but again absolutely no evidence to support their claim. This is a very obvious over use of The Departments power and it appears they are using this as a stalling tactic to prevent F2F ever having its day in court. That said, they have had me sign an undertaking not allowing me to have any company assets to be sold (another obvious tactic to empty our pockets). All that said legals and court cases are not cheap and given the fact that we can not sell company assets, combined with non payment from The Department, I have had no choice but to sell any personal assets with equity. Not too sure how the rumours get started but please know that there is no big stash of cash hidden away anywhere, this has been an unfair and terrible time for everyone involved but please be aware that I have been here stepping up to them for us all for the past 5 months. Please do not see this as a rant, I am simple trying to bring everyone up to date and avoid anymore crazy rumours. Regards, Paul".
